In another case that highlights the importance of retaining complete and accurate employment records an Ultra Tune outlet has been fined $135,000 for record keeping breaches.

A casual worker raised a concern with the Fair Work Ombudsman in 2022 that they were not receiving appropriate penalty rates.  As a result the Fair Work Ombudsman investigated the site and found a series of breaches, including payslip and employment record keeping breaches.

Speaking on the penalty handed down this week, Fair Work Ombudsman Ms Booth said;

“Record-keeping is the bedrock of compliance and pay slips provide employees with the clarity they need about their pay. We expect every employer to follow laws requiring them to issue pay slips within one working day of each pay day and to make and keep accurate employment records for their employees.”

“Any employees with concerns about their pay or entitlements should contact the Fair Work Ombudsman for free assistance.”

Learnings for all businesses

“What is important to understand about this case is that this penalty arises from the old framework.  Should the same breaches be identified today this business would be facing penalties starting at $1.56M and up to 10 years in jail”, explains ACAPMAs Elisha Radwanowski.
